CargoSprint LLC ("CargoSprint") and its subsidiaries (collectively "we", "us" or "our") care about your privacy. This Privacy Policy applies specifically to (i) the CargoSprint website www.cargosprint.com, (ii) SprintPay, inclusive of the SprintPay app, SprintPay for Freight Forwarders, (iii) SprintPay for Cargo Facilities, (iv) SprintPass inclusive of SprintPass for Cargo Facilities, (v) SprintPass for Trucking Companies, (vi) SprintPass Light and the SprintPass Driver App, as well as proprietary road feeder service modules, (vii) the CargoSprint, SprintPay, SprintPass Chatbots on the website and apps, (viii) CargoSprint, SprintPay, and SprintPass customer service calls, (ix) SprintPay emails, (x) SprintPay or SprintPass SMS/text messages, and (xii) SprintPay and SprintPass account registrations (collectively the "Services").

The purpose of this Privacy Policy is to explain how we collect personal information, what we collect, how we use it, how we share it, and what controls and choices you have.

1.- What information do we collect?

We collect three types of information through your use of the Services: Personal Information, Business Data, and Cargo Data.

When you use any of the Services, Personal Information, Business Data, and or Cargo Data may be collected directly from you, automatically from your device, or from third parties for example, when you create an account, confirm a shipment pickup or delivery, request a payment to a cargo facility, write a review, or contact us.

Personal Information is data that identifies, relates to, describes, can reasonably be associated with, or can be reasonably linked directly or indirectly to a particular individual or household and may include identifiers; internet and electronic network activity information, such as information about your interactions with the Services; inferences about you, including about your preferences; and geolocation data, including the following:

  1. First name and last name
  2. Address
  3. Email address
  4. Phone number
  5. The capture of facial scan images and processing of biometric identifiers by and for Onfido, a third-party identity verification service provider. We do not collect or store such information.
  6. Government issued identification, such as a driver’s license
  7. Your job title
  8. Location data
  9. Account data such as the username and password that you may set to establish an account on the Services, and any other information that you add to your account profile.
  10. Your device if you use a SprintPay or SprintPass application on mobile or other platforms, we may collect analytic information about your device, such as IP address, device ID, OS version, and clickstream. We can use your IP address to determine your general location.
  11. Communications data based on our exchanges with you, including when you contact us with questions or feedback or support requests, through the Services or otherwise. We may record phone calls made to our customer service for quality assurance purposes.
  12. Usage and Log Data: When you interact with our Services, we may collect information from your device or web browser when you interact with the Services. For example, when you interact with the Services, we may log and store your IP address and technical information about your usage like your device ID, browser type, how you progressed through the Services, where you abandoned it, etc.
  13. Other information you choose to provide that identifies, relates, describes or can reasonable be linked to or associated with you.

Business Data refers to information about the organization you may work for and may include professional information, including the following:

  1. Name of the organization or business
  2. Business address, phone number and email
  3. Job titles of your colleagues
  4. The structuring of the organization
  5. Tax ID of your organization

Cargo Data is information related to your inbound or outbound freight and may include financial information and commercial information including records of services performed, including the following:

  1. Air Waybill (AWB), Master Air Waybill and House Air Waybill (HAWB) information
  2. Destination airport
  3. Cargo facility to be paid
  4. Cargo pickup date
  5. Information about what your payment will cover (for SprintPay)
  6. Amount to be paid (for SprintPay)
  7. Type of cargo (for SprintPass)
  8. Pickup number (for SprintPass)
  9. Other references you choose to provide regarding your shipment, pickup or drop-off

2.- Why do we collect this information?

We may use all three types —Personal Information, Business Data, and Cargo Data (see Section 1)— to:

  1. provide, maintain, and improve our Services in accordance with our Terms of Use;
  2. process a payment on your behalf;
  3. provide customer support as well as prevent, detect or address technical, fraud, or security-related issues;
  4. monitor and improve our Services;
  5. notify you about changes to our Services, including this Privacy Policy;
  6. develop new products and solutions;
  7. with your consent, provide you with news, special offers, and information about other products and events which we offer that are similar to those that you have already purchased or enquired about;
  8. comply with our legal obligations. We may use your personal information to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities
  9. protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);
  10. audit our internal processes for compliance with legal and contractual requirements or our internal policies;
  11. enforce the terms and conditions that govern the Services; and
  12. prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

If you are located in the European Economic Area (EEA), CargoSprint’s legal basis for collecting and using the data described in this Privacy Policy depends on the information we collect and the specific context in which we collect it. For example, we use your data, including Personal Information, as necessary to fulfill our obligations to you as stated in our Terms of Use. Except as otherwise stated, we may use the data described in this Privacy Policy for the legitimate business purpose of providing our Services to you, including, but not limited to: to respond to your requests

  21. at your request, to process a credit card payment via an independent third-party controller such as PayPal to perform this service solely for the intended Services.   22. for research and development. We may use your personal information for research and development purposes, including to analyze and improve the Services and our business. As part of these activities, we may create aggregated, de-identified and/or anonymized data from personal information we collect. We make personal information into de-identified or anonymized data by removing information that makes the data personally identifiable to you. We may use this aggregated, de-identified or otherwise anonymized data and share it with third parties for our lawful business purposes, including to analyze and improve the Services and promote our business

3.- Do we use Cookies?

We use digital tools to collect information to make the Services functional and improve your experience with it. In this Privacy Policy and our Cookie Policy, we refer to these tools and other unique identifiers like beacons, tags, and scripts, as “Cookies”.

Cookies are files with small amounts of data that are sent from a website and stored on your device. They are commonly used to provide essential functions on a website as well as improve the user experience.

Strictly Necessary Cookies are used in order to keep the Services running. These cookies are essential to provide you with services available through our Services and to enable you to use its features. For example, they allow you to log in to secure areas of our Services and help the content of the pages you request load quickly. Without these cookies, the services that you have asked for cannot be provided, and we only use these cookies to provide you with those services.

Statistics Cookies serve to understand how you interact with our website and systems so we can improve designs, features and other user-related content.

Preference Cookies allow the Services to remember choices you have made in the past so as to improve the experience.

Marketing Cookies which are managed by third-parties to curate the ads you see on other websites through your browser.

To be clear, CargoSprint, SprintPay, and SprintPass do not, and cannot, track your activity when you are not using the Services and does not collect activity about your online activity after you leave the Services.

Google Analytics. We may collect personal information about your online activities on websites and connected devices over time and across third-party websites, devices, apps and other online features and services. We may use third-party analytics services, such as Google Analytics and Firebase. The information we obtain may be disclosed to or collected directly by these providers and other relevant third parties who use the information, for example, to evaluate use of the Services and to help administer the SprintPay and SprintPass apps. 4.- How long will my data be kept?

CargoSprint will retain your data only for as long as is necessary for the purposes set out in this Privacy Policy. Furthermore, we will retain and use your data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

5.- Does my data get transferred to third parties and where is it stored?

We do not transfer your information to third parties in exchange for money and we will not do so. However, we do transfer personal information to certain third parties in order to operate our business (for example, to power some of the features making up our Services).

We may share your data with our affiliates, service providers, certain third parties, and as necessary for legal requirements.

Affiliates. Affiliates are companies that control, are controlled by, or are under common control with us. We may share your data with our affiliates.

Service providers. Service providers are partners who have agreed to use your data only for the purpose of providing the services in our contract. We may share your data with our service providers who help us by providing our electronic infrastructure, security, user communications, and data storage.

Third parties. Third parties are unaffiliated companies that have not agreed to limit their use of your data only to provide the services in our contract. For example, they may need to use the data to provide you services directly that go beyond our contract with them (e.g. Google Analytics, which processes usage data across multiple apps and services, including those not controlled by us. We share your data with “third parties” only as allowed by applicable law. Also, for certain features, please be aware that you are providing your information to an independent third party that is collecting and using your information to provide the feature, such as digital wallet services made available by providers such as Apple and Google, which are not controlled by us. You should review such third-party privacy policies to learn what information they collect and how such information is used, shared and secured because we are not collecting such data and do not control these third parties’ practices.

We might not store or collect your payment card information or banking details. That data may be provided directly to our third party payment processors whose use of your information is governed by their privacy policy and is not controlled by us. You should review such third-party privacy policies to learn what information they collect and how such information is used, shared and secured because we are not collecting such data and do not control these third parties’ practices. These payment processors are required to be compliant with the Payment Card Industry (PCI) Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express, PayPal and Discover to help secure handling credit card information.

Your data, may be transferred to—and maintained on—servers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including your Personal Information, to the United States and process it there and other jurisdictions. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

CargoSprint will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

Keep in mind that, under certain circumstances, CargoSprint may be required to withhold data about you or disclose data about you to a third party other than as outlined above because:

  1. You have given us permission to do so
  2. We are required to comply with the law, relevant regulations, or an enforceable government request
  3. We need to perform a contract with you
  4. We must comply with a legal obligation
  5. It is in our legitimate interest and is not overridden by your rights
  6. We need to prevent or investigate possible wrongdoing such as money-laundering or fraud
  7. In order to protect the personal safety of users of the Services or the public

6.- What data security measures do we employ?

We are committed to protecting your information and consequently implement reasonable measures to provide safeguards against the misuse, loss, unauthorized disclosure or unauthorized acts with your data. For example, we implement security features like HTTPS to encrypt communication channels.

Your data security is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security. Likewise, you are also responsible for keeping your passwords private as well as making sure that the information you provide us is updated and correct.

7.- Links and gateways to other sites and services

Our Services may contain links and gateways to other sites and services that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the privacy policy of every site you visit. In addition, you may be directed to a third party’s services for certain services that are made available through our Services but which are not controlled by us, such as digital wallet services and payment processing services.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

8.- Privacy of persons under the age of 1

Our Services do not address anyone under the age of 18. We do not knowingly collect Personal Information from anyone under the age of 18 ("Minor"). If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from a Minor without verification of parental consent, we take steps to remove that information.

9.- What are my rights and choices as a user of the Services?

In this section, we describe the choices available to all users. While we treat all users the same, users who are located in California can find information about their rights below. CargoSprint aims to take reasonable steps to allow you to correct, amend, limit, or delete information about you. Consequently, and depending upon where you are located and under applicable law, you may have the following data protection rights:

  1. Information you provide to us. You are in control of the information that you choose to directly provide to us
  2. Your account. If you have registered for an SprintPay account, you may review, update, and edit certain account information by logging into the account. You may also edit through your profile settings in the SprintPay app.
  3. To accept or decline marketing and other promotional material. In some areas, we must obtain your consent in order to contact you with newsletters, marketing or promotional materials, and other information that may be of interest to you. Regardless of your location, you may opt-out of receiving any, or all, of these communications from us by clicking the “Unsubscribe” link in the footer of our emails.
  4. To answer or reject surveys: we may use the information you provide us to contact you with surveys to improve our products and services, as well as develop new solutions to better serve you and others.
  5. To restrict Cookies: you can instruct your browser to refuse all Cookies or to indicate when Cookies are being sent. However, if you do not accept Cookies, you may not be able to use some features of our Services.
  6. To modify settings for “Do Not Track” signals: we are not part of a “Do Not Track” framework. “Do Not Track” is a preference you can enable or disable on your web browser to inform websites that you do not want your activity on your internet browser being traced.
  7. To be informed: if you want to know what Personal Information we hold about you.
    1. In some areas, this may include the right to receive your personal data (as defined under the GDPR) or Personal Information in a structured, machine-readable and commonly used format, and/or identification of the categories of sources for that information, the business or commercial purposes for collecting the information, and the categories of third parties with which the information was shared.

  12. To delete: you may request that we delete your Personal Information, subject to certain exceptions and limitations provided under applicable law.
  13. To withdraw: you may withdraw your consent at any time where CargoSprint relied on your consent to process data about you. However, this may restrict your ability to use the Services.

Please note that we may ask you to verify your identity before responding to such requests. Also, please understand that not all of the above rights and options may be available to users in all locations, depending upon applicable law in your jurisdiction. Please note that your request will not be processed until your identity is confirmed.

If you are a resident of the European Economic Area (EEA), and are dissatisfied with how your information is collected and used, you may submit a complaint to the corresponding Data Protection Authority. For more information, please contact your local data protection authority in the EEA.

If you choose to exercise your rights, we will not charge you different prices or provide different quality of services unless those differences are related to your Personal Information or otherwise permitted by law

Notice to California Residents

California residents have the rights listed below under the California Consumer Privacy Act (“CCPA”). However, these rights are not absolute, and in certain cases we may decline your request as permitted by law.

Information. You can request the following information about how we have collected, used, and disclosed your Personal Information during the past 12 months:

In submitting a request, we may ask you to verify your identity so that we can protect you against fraudulent requests for your information. Thus, we may ask you to sign into your account, to provide information about your identity or residence, or provide other confirming information to allow us to verify your identity.

As a California resident, you may appoint an authorized agent to exercise your rights on your behalf. In order for us to honor a request made by your agent, you must submit proof of your written authorization of the agent to inquiries@cargosprint.com prior to submitting a request.

10.- Policy updates

Our Privacy Policy and Cookie Policy have been designed and implemented in compliance with effective global regulations on data protection. However, we may update these policies from time to time. When substantial changes are made to either of these policies, we will use reasonable measures to notify you. However, you may view our policies located on our website cargosprint.com and are strongly advised to review them periodically for any changes.
